Terms and Conditions

If this Application is submitted and approved via email by U.S. Fund for UNICEF (“UNICEF USA”) it shall become a contract and shall be subject to the following terms:

  1. Contributions to UNICEF USA which are received by the Applicant ("Individual Contributions") and made by the Applicant will be sent to UNICEF USA no later than thirty (30) days after the Fundraiser/Event. The Individual Contribution and the Applicant's Contribution will be paid in United States dollars and sent via PayPal to donate@unicefusa.org OR online at Fundraiser + Event Donation Form .

  2. In performing its obligations under this Application, the Applicant will comply with all applicable federal, state, and local laws and regulations including, but not limited to, all laws and regulations that regulate statements to the public concerning the amount of the Contribution. Each reference to the Applicant's Contribution will specifically and accurately describe the Applicant's Contribution (e.g., Income less expenses should not exceed 25% of revenue and should be submitted within 30 days of the event).

  3. Applicant will state that no portion of the purchase price of any goods/services sold at the Fundraiser/Event is tax deductible unless donation is made directly to UNICEF USA using the above mentioned channels. If such is the case, the Individual donor will receive an acknowledgement letter from UNICEF USA for use as a tax-deductible receipt.

  4. The Applicant will not represent that UNICEF USA or UNICEF is a producer, co producer, sponsor, or presenter of the Fundraiser/Event.

  5. This Application does not create any partnership, agency, or joint venture relationship between the Applicant and UNICEF USA or UNICEF, and neither UNICEF USA or UNICEF nor the Applicant will make any representations to the contrary.

  6. Upon approval of the Fundraiser/Event, Applicant may state in promotional materials that proceeds from the Fundraiser/Event will be donated to UNICEF USA. In connection with such statements, and for no other purpose, UNICEF USA grants to the Applicant a non-exclusive license to use the UNICEF USA name and logo upon and in connection with the Fundraiser/Event. The Applicant shall have no right to grant any sublicenses under this Agreement. The Applicant will provide UNICEF USA with sample copies for approval of all publicity or promotional materials that include USF's name or logo prior to publication or distribution.

  7. If UNICEF USA determines, in its sole discretion, that the Fundraiser/Event or related activities could injure the goodwill or reputation of UNICEF USA, UNICEF USA may terminate this Agreement immediately. Upon the expiration or sooner termination of Fundraiser/Event, the Applicant shall discontinue using the UNICEF USA name and logo and all materials that reference the Fundraiser/Event.

  8. Applicant is not permitted to dispense or serve alcoholic beverages at approved Fundraiser/Events where individuals under the legal drinking age are to be in attendance.

  9. Applicant acknowledges and agrees to abide by UNICEF USA’s Child Safeguarding Policy and Diversity, Racial Equity and Belonging Policy.

  10. This Application requires that the Applicant carry liability insurance for the Fundraiser/Event. The Applicant can obtain insurance coverage from Philadelphia Insurance Company or a company of their choosing. UNICEF USA will also allow the applicant to waive the liability insurance requirement and still be permitted to host the Fundraiser/Event. The Applicant understands by waiving the obtaining of insurance means that the applicant will bear the costs of their own losses such as via fire, theft, injury, and so forth. UNICEF USA strongly recommends and prefers that the Applicant obtain insurance coverage.

  11. Applicant shall release, defend, indemnify, and hold UNICEF USA, its directors, officers, employees, agents, attorneys, representatives, volunteers, successors and assigns, harmless from all claims, liabilities, judgments, penalties, losses, costs, damages and expenses (including reasonable attorneys’ fees, whether or not litigation is instituted) paid or incurred by UNICEF USA by reason of any activities relating to this Fundraiser/Event.
