Community Fundraising Terms and Conditions
By organizing a community fundraiser on behalf of UNICEF USA (“Fundraiser” or “Organizer”), you agree to the following terms:
1. Purpose and Relationship
- Fundraisers benefit UNICEF USA. UNICEF USA’s only role is as the exclusive beneficiary and as owner of its name and trademarks.
- Nothing in these terms creates an agency, partnership, joint venture, or employment relationship between UNICEF USA and Organizer, hosts, supporters, or participants.
- Organizer is an independent party and has no authority to bind UNICEF USA or make representations on UNICEF USA’s behalf except as expressly authorized in writing.
2. Donations and Tax Treatment
- Only gifts made directly to and payable to UNICEF USA, a U.S. 501(c)(3) tax-exempt organization, are tax-deductible to the extent allowed by law.
- Organizers and donors should consult a tax advisor about deductibility. UNICEF USA disclaims liability for tax consequences to donors.
- UNICEF USA makes no representation regarding the tax treatment of any contribution received in connection with a Fundraiser organized by a third party.
3. Use of Funds
- All funds raised for the Fundraiser, less any agreed and lawful event expenses, will be remitted to UNICEF USA to support its charitable mission. Organizer must provide an accounting of gross receipts and expenses when requested. Funds must be remitted to UNICEF USA within thirty (30) days following the conclusion of the Fundraiser.
4. Organizer Responsibilities
- Organizer is solely responsible for planning, promoting, staging, staffing, and managing the Fundraiser and for compliance with all applicable federal, state, and local laws, rules, and regulations, including but not limited to charitable solicitation registration requirements in any jurisdiction where the Fundraiser is conducted or solicitations are made.
- Organizer must obtain all required permits, licenses, approvals, and insurance (including general liability and any other coverage required by law or customary practice).
- Organizer is responsible for any contracts, vendor agreements, refunds, damages, injuries, claims, or liabilities arising from the Fundraiser.
- Organizer shall not make any false, misleading, or deceptive statements in connection with the Fundraiser or any solicitation or contributions.
5. UNICEF USA Liability
- UNICEF USA does not assume responsibility for the conduct, representations, omissions, or actions of the Organizer, volunteers, vendors, or participants.
- UNICEF USA is not liable for any injury, loss, damage, or claim related to attending, organizing, or participating in the Fundraiser.
- To the fullest extent permitted by law, UNICEF USA disclaims all warranties, express or implied, regarding the Fundraiser.
6. Use of Name, Logo, and Materials
- Organizer may use UNICEF USA’s name and logo solely in connection with the Fundraiser and in accordance with any brand guidelines provided by UNICEF USA.
- Permission to reference UNICEF USA does not imply endorsement of the Fundraiser, its organizers, or activities beyond the charitable purpose.
7. Prohibited Activities
- Organizer may not, in connection with the Fundraiser:
- Conduct raffles, gambling, or gaming activities unless expressly permitted by UNICEF USA in writing and compliant with applicable laws;
- Sell alcohol without appropriate licensing and insurance;
- Engage in political campaigning, lobbying, endorsements, or activities supporting/oppose political candidates or parties;
- Partner with organizations, sponsors, products, or activities that conflict with UNICEF USA’s mission, harm its reputation or could jeopardize UNICEF USA’s tax-exempt status;
- Make any representation that contributions are tax-deductible unless such contributions are made directly and payable to UNICEF USA;
- Undertake any activity that could create legal liability or financial exposure for UNICEF USA.
8. Compliance and Right to Terminate
- Organizer shall comply with all applicable laws, including federal and state charitable solicitation laws, consumer protection laws, and tax laws. UNICEF USA reserves the right to request documentation demonstrating Organizer’s compliance with these terms and applicable law.
UNICEF USA reserves the right to refuse use of its name, revoke permission, require changes to the Fundraiser, or terminate support at any time if Organizer fails to comply with these terms or if the Fundraiser poses reputational or legal risk.
9. General
- These terms are governed by applicable U.S. law. Any provision found unenforceable will be modified to the minimum extent necessary to make it enforceable while preserving the intent of the parties, and the remaining terms shall remain in full force and effect.
