Grant of Rights; Waiver and release

By submitting your volunteer story (“Story”) you: (a) grant the United States Fund for UNICEF (“USF”), its agents, licensees, and assigns an irrevocable, perpetual, royalty-free, non-exclusive, right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your Story as-is or as-edited (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review or approval from you or any other party; (b) forever waive any rights of copyrights, trademark rights, privacy rights, and any other legal or moral rights that may preclude USF’s use of your Story, or require any further permission for USF to use your Story; and (c) agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against USF on the grounds that any use of the Story, or any derivative works, infringes any of your rights as creator of the Story, including, without limitation, copyrights, trademark rights, and moral rights.  With respect to any photographs or other materials submitted with your Story, you grant the USF permission to use such likenesses, voices, pictures, and names in any legal manner for public relations or otherwise, in any or all means or media now known or later invented, and the right to copyright same (“Publicity Rights”).  You waive all right of inspection and approval, and release the USF, its directors, affiliates, partners, officers, agents, servants, contractors, employees, representatives, and volunteers, and their respective successors, assigns, heirs, and personal representatives, from any and all liability arising out of the exercise of the Publicity Rights hereby granted.  By submitting your Story, you represent and warrant that (1) your Story and any photographs or other submitted materials do not violate any third party’s rights, and (2) to the extent your Story and any photographs or other submitted materials feature individuals other than yourself, you have written permission from each individual (or his/her parents or legal guardians if under age 18) to grant the rights to USF described above, and can make written copies of such permissions available to USF upon request. 

You hereby waive, release, and forever discharge USF, its directors, affiliates, partners, officers, agents, servants, contractors, employees, representatives, and volunteers, and their respective successors, assigns, heirs, and personal representatives (each an “Indemnified Party”) from and against any and all claims, cost, liabilities, damages, obligations, expense, losses, or judgments, including attorney fees and court costs (herein collectively “Claims”) arising out of or by reason of any activities relating to the fundraiser and/or awareness raising event, including without limitation, any illness or injury (including death), even if any such Claim may arise out of negligence or carelessness on the part of any Indemnified Party, and agree to indemnify, defend and hold harmless the USF and each Indemnified Party from and against any and all such Claims by third parties arising out of or by reason of any activities relating to the fundraiser and/or awareness raising event. You further hereby agree to indemnify, defend and hold harmless USF and each Indemnified Party from and against any and all such Claims arising out of or by reason of any use, production or reproduction of the Story and any photographs or other submitted materials, including without limitation any Claims for invasion of privacy or publicity, or by reason of any breach of your representations and warranties made hereunder.
